CRÍTICA A LA JURISPRUDENCIA DEL TRIBUNAL CONSTITUCIONAL PERUANO QUE DESARROLLA LA “ECONOMÍA SOCIAL DE MERCADO”

Abstract


This paper discusses the impact of the concept of “social market economy” within Peruvian legal system , with a focus on judges’ opinions. Among them,  it is important to review the ones that have given content and impact on the discussion regarding the influence of certain economic doctrines on law. The first jurisprudential reference is coming from the decisions of the Peruvian Constitutional Court. This body develops constitutional jurisdiction in the form of concentrated control. This court issues “binding precedents” where the jurisprudential line that the other courts and courts have the obligation to follow is determined in a certain way. There is no development at the level of binding precedents on the institute of the “social market economy”, but there are multiple sentences that include this institute.
