IL CONTRASTO AL CAPORALATO E ALLO SFRUTTAMENTO DEL LAVORO IN AGRICOLTURA: UN ITINERARIO TRA FONTI SOVRANAZIONALI E MODELLI STATALI

Abstract


In the agricultural sector, illegal recruitment and exploitation of workers are old-age phenomena that factors such as the increased competitiveness in the global market, the intensification of migration flows, and the appearance of international criminal networks have rendered more and more dramatic in Italy as in other regions of the world. After an outline of the main reasons that have caused the widespread diffusion of those phenomena in recent decades, an overview of the composite regulatory framework and the measures to contrast them, available at both the supranational and domestic levels, are presented. The paper then offers an analysis of English law as an example of a regulation model which, differently from the Italian model, is based on a licensing scheme.
