STILL “ANYTHING UNDER THE SUN”? PATENT ELIGIBILITY AFTER BILSKI

Abstract


Everyone who is involved in patent law awaited the US Supreme Court decision in
Bilski. For the first time ever, the case is related to a pure type of business method, not
tied to any device and not resulting in a tangible product. Therefore Bilski is the perfect
candidate for a landmark case and a turning point in US patent law.
